Mr. Rafael Dueñas is one of our firm’s labor and employment experts and has been licensed to practice in México since 2000. His practice is focused on advising and representing clients in a variety of matters related to labor and employment, such as settlement of disputes with unions, negotiation of collective bargaining agreements, labor and employment compliance and employment litigation. 

Mr. Dueñas effectively advises clients in the preparation and negotiation of documents such as internal shop rules, employee handbooks, personnel policies, benefit plans, employment contracts and severance agreements. Mr. Dueñas also conducts seminars on emerging labor and employment law issues to employers.

For more than 15 years, he has worked on a wide range of labor and employment cases, including, preparation of individual employment agreements, labor contracts, collective bargaining agreements, establishment of overall policies and internal shop rules, termination notices, settlement agreements, employer substitution procedures,  and all kinds of employment, administrative and labor litigation including representation of employers before the Conciliation and Arbitration Boards and litigation and amparo (constitutional challenge) proceedings derived from labor and employment lawsuits.

Prior to joining our firm, Mr. Dueñas worked for the local government of Baja California in numerous positions related to labor and employment law, including working as Labor Inspector, Assistant Prosecutor of Labor Defense and Judicial Secretary of the Tijuana Labor Board, among others.

  • Advises and represents a major telecommunications company in Mexico during all types of litigation related to employment practices.
  • Represented numerous companies during Labor and Employment procedures such as terminations of employment, wrongful termination litigation, settlements, and trial hearings.
  • Successfully advised numerous foreign and domestic clients from all industrial sectors during labor and employment trials.
  • Effectively coordinates numerous lobbying efforts before labor authorities at the local and federal level.
  • Consistently represents one of the world’s largest companies in the aerospace industry in all matters and issues related to labor and employment, actively engaging in all of the company’s negotiations with union leaders, as well as providing effective representation before government agencies at the federal, state and local levels.
  • Assists our labor and employment team in the representation of a global Japanese electronics company during all stages of labor and employment trials before local labor boards throughout Mexico.
